The Exception to Legislative Immunity for “Cases Subject to Article 14 of the Constitution as Long as an Investigation Has Been Initiated Before the Election” as a Problem of Democracy

Abstract

Anayasa’nın 83. maddesine göre yasama dokunulmazlığının istisnasını oluşturan “seçimden önce soruşturmasına başlanılmış olmak kaydıyla Anayasa’nın 14. maddesine giren durumlar”, istisnanın kötüye kullanılmasını kolaylaştıran bir belirsizlik içermektedir. Anayasa Mahkemesi, hukuk devleti ilkesinin bir gereği olan öngörülebilirlik kriterini taşımayan bu kuralın mevcut haliyle uygulanmasının seçilme ve siyasi faaliyette bulunma hakkını ihlal edeceğine karar vermiştir. Mahkemenin bu istisnaya yönelik içtihadı, yasama organına bu istisnanın kapsamını ve uygulamasında göz önünde bulundurulması gereken kriterleri belirleme yükümlülüğü de yüklemiştir. Ancak bu çalışmada, söz konusu istisnanın demokratik hukuk devleti ilkesi açısından yarattığı risklerin istisnanın daha detaylı düzenlenmesiyle ortadan kaldırılamayacağı ileri sürülmüştür. Çalışmanın önerdiği çözüm, bu istisnanın Anayasa’nın 83. maddesinden çıkarılmasıdır. Zira yasama dokunulmazlığının amacı, işlevi ve sınırları Türkiye bağlamında ele alındığında istisnanın sadece seçim sonrasına değil seçim öncesi siyasal alana da keyfi müdahaleyi mümkün kıldığı ve böylece demokratik hukuk devleti ilkesine ciddi şekilde zarar verme potansiyeli taşıdığı açığa çıkmaktadır.

The exclusion of the member of the parliaments from inviolability concerning the “cases subject to Article 14 of the Constitution as long as an investigation has been initiated before the election” according to Article 83 of the Constitution of Türkiye entails ambiguity, facilitating the misuse of this exception. The Constitutional Court has ruled that the implementation of this rule, which lacks the foreseeability criterion inherent to the principle of the rule of law, constitutes a violation of the right to stand for election and to engage in political activities. The Court’s jurisprudence on this exception imposes an obligation upon the legislature to define the scope and criteria that must be considered in its application. However, this study argues that the risks posed by this exception to the democratic rule-of-law principle cannot be eliminated merely through more detailed regulation. Instead, the study proposes the removal of this exception from Article 83 of the Constitution. Indeed, when considering the purpose, function, and limits of legislative immunity within the Turkish context, it becomes evident that this exception has the potential to seriously harm the democratic rule-of-law principle by enabling arbitrary interference not only after but also before elections in the political arena.
